
The settlement wasn’t the full stop Berkshire hoped for
Berkshire Hathaway Energy tried to argue it should be covered by HomeServices of America’s $250 million settlement in the real estate commission mess. A federal judge in Missouri wasn’t buying it.
Judge Stephen Bough said the two entities aren’t one giant legal blob for antitrust purposes, which means Berkshire can’t just wave the earlier deal around like a get-out-of-jail-free card.
Why investors should care
This is less about a headline-grabbing one-off payment and more about a lingering liability cloud. Berkshire is famous for having a fortress balance sheet, but that also means plaintiffs know there’s plenty of money on the table.
